Driving Without a Commercial License (CDL)

The crime of driving without a valid commercial license (or CDL) is listed under RCW 46.25.050. If a driver is operating a commercial vehicle that is designated within the state and federal “gross weight rating” (GVWR) requirements, a driver will be charged with this offense if they do not possess a valid CDL. This charge is a gross misdemeanor offense and carries a maximum sentence of 364 days in jail in a $5,000 fine. If a person is convicted of this charge, it may also carry possible licensing consequences and could jeopardize their ability to get a commercial license in the future. Any charge involving a commercial license or driver is complicated and involves a detailed assessment of state and federal regulations and exceptions. Accordingly, anyone who operates a commercial vehicle for a living should always consult with an attorney if charged with any type of driving offense or infraction.
